KMS licensing is based on mailbox count. If I have a server with 100 users on it, and want to put up a 2nd mail server to act as a backup MX in another location, would that fall under the same licensing if it is for the same 100 users? Question

Your backup MX server would not contain separate mailboxes, but simply store all incoming mail in one bunch to be forwarded once the primary MX gets back online.

So yes, you would need a KMS license for the backup server, but no it would not have to contain 100 licensed mailboxes. (AFAIK)
