I believe that in the case of a queue, 40 and 40p1 are treated in a way whereby one being busy doesn't exclude the other from ringing. If 40 (and 40p1) are extensions of an individual person who might be answering a queue from the office in some circumstances and at home (or mobile) in other circumstances then my advice would be to provide a dynamic login for that user.

For example, *789 to login and *987 to log out. In this way the user can pick which phone they'd like to have entered in the queue.

Hm... log in - log out doesn't work for this case.

i have tried a little bit, and it works, if i set the option "use the above rules also for ringing groups and call queues" in the extension settings.
